Terms of Service
These Terms of Service ("Terms") govern your use of the torchdaw.com website, the TORCH Hub application, and TORCH DAW (together, the "Products") provided by TORCH DAW ("we", "us"). By downloading, installing, or using the Products, you agree to these Terms.
1. The License
When you purchase TORCH DAW, we grant you a perpetual, non-exclusive, non-transferable license to install and use the software for making music — personal or commercial. It is a one-time purchase of $100 USD; there is no subscription and no recurring fee.
- Activations: your license may be activated on up to 3 machines that you own or control.
- Updates: version updates are delivered through TORCH Hub and included with your license.
- Your music is yours: we claim no rights in the audio, MIDI, or projects you create with TORCH DAW.
2. Free Trial
TORCH DAW includes a free trial with full access to its features. The trial starts inside the app — no credit card is required. Trial terms (including duration) are presented in-app and may change for future versions. Continued use after the trial requires a purchased license.
3. TORCH Hub and the Offline Vault
TORCH Hub is our free install center. It downloads, installs, updates, and reinstalls our products, and keeps an offline vault of installers on your machine so you can reinstall without an internet connection. The Hub and its vault are provided for use with genuine TORCH DAW products and licenses.
4. Purchases and Refunds
Purchases are processed by our merchant of record, Lemon Squeezy (torchdaw.lemonsqueezy.com). Billing, taxes, and payment handling are subject to Lemon Squeezy's terms. If something is wrong with your purchase, contact us at torchdaw@gmail.com and we will work with you to make it right.
5. What You May Not Do
- Redistribute, resell, rent, or sublicense the software or your license key.
- Circumvent, remove, or defeat license activation or trial mechanisms.
- Reverse engineer or decompile the software, except where the law expressly permits it.
- Use the Products to infringe the rights of others (including sample and copyright law).
6. Product Updates
TORCH products continue to receive maintenance, compatibility, workflow, and feature updates. Current release notes and available downloads are delivered through TORCH Hub.
7. TORCH AI Assistant — Your Selected Service
The TORCH AI assistant uses a service that you select and configure. We do not provide, control, or bill for third-party AI services. Your use of any selected service is governed by that provider's terms, and any provider fees are your responsibility.
8. Third-Party Plugins
TORCH DAW can host third-party VST3 and Audio Unit plugins. Those plugins are licensed separately by their vendors; we are not responsible for their behavior, licensing, or support.
9. Disclaimer of Warranty
THE PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE PRODUCTS WILL BE UNINTERRUPTED OR ERROR-FREE.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TORCH DAW SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR REVENUE, ARISING FROM YOUR USE OF THE PRODUCTS. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR YOUR LICENSE.
11. Termination
We may terminate your license if you materially breach these Terms and do not cure the breach after notice. Sections that by their nature should survive (including Sections 9 and 10) survive termination.
12. Changes to These Terms
We may update these Terms from time to time. Material changes will be posted on this page. Continued use of the Products after changes take effect constitutes acceptance of the updated Terms.
